WELL, THE DECISION IS IN ON 6 TICKETS Santa Cruz County Superior Court Judge Danner Decides! November 1, 2001
. . . AND APPEALED.
The Record, because there was no court reporter, was adopted from my Proposed Statement on Appeal, which I took from the audio tapes I was provided of the various hearings. This IS the official record of the events . . . only available in pdf format.)
Statement on Appeal
(Testimony of Officers, in Order of Appearance)
Santa Cruz County Sheriff Deputy Thurber
Santa Cruz County Sheriff Deputy Muting
California Highway Patrol Officer Ulrich
Santa Cruz County Sheriff Deputy Pifferini
Santa Cruz Police Officer Martin
Santa Cruz County Sheriff Deputy Watson
It is beyond amazing that this record was certified WITHOUT AMENDMENT as the official record of the proceedings and testimony. It's a virtual confession to prosecutorial misconduct by the District Attorney, and of judicial malfeasence by the court. No attorney would have ever had to put up with this.
APPEAL BRIEFS
The Opening Brief on Appeal was filed on June 03, 2002 (right on time!), the Reply Brief was filed by the DA on June 23, 2001, the then the Final Brief (pdf) filed by us on July 03, 2002.
The Appellate Division of the Superior Court upheld the six convictions, the plain language of the law and the ruling court deicsion notwithstanding, even in the face of the record demonstrating "there was no trial." Justice in Santa Cruz? . . . not in court. On the other hand, not one officer has stopped or cited me in Santa Cruz County in over two years. I guess cops are more honorable than judges after all.
